1. Acceptance of Terms

By accessing or using the Diamond Arm Lab website (diamondarmlab.com) or web application ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

The Service is operated by Major League Activation LLC, a Washington State limited liability company ("we," "us," or "Company"). These Terms constitute a binding legal agreement between you and Major League Activation LLC.

2. Description of Service

Diamond Arm Lab is a web-based application designed to help youth baseball and softball athletes, parents, and coaches track throwing workloads and manage arm care through:

• Acute:Chronic Workload Ratio (ACWR) tracking and monitoring

• Throw session and bullpen logging

• Personalized arm care recommendations based on workload data

• Exercise and strength training logging

• Coach portal for team roster management

• SMS reminders for scheduled throwing sessions

• AI-assisted video mechanics analysis (where available)

3. Accounts and Eligibility

To access the Service, you must create an account. You agree to:

• Provide accurate, complete, and current information

• Maintain the security of your account credentials

• Notify us immediately of any unauthorized access

• Accept responsibility for all activity under your account

The Service is available to users 18 years of age or older. Users between 13 and 17 may use the Service only with verifiable parental or guardian consent. See Section 4 for rules governing users under 13.

4. Children's Privacy (COPPA)

Important: Diamond Arm Lab tracks data for youth athletes, including children under 13. We comply with the Children's Online Privacy Protection Act (COPPA).

If a player being tracked is under 13, the account must be created and managed by a parent or legal guardian. By creating an account for a player under 13, you represent that you are that player's parent or guardian and consent to the collection and use of information as described in our Privacy Policy.

We do not knowingly allow children under 13 to create their own accounts. If we discover this has occurred, we will delete the account and associated data promptly.

Parents may request to review, update, or delete their child's data at any time by contacting matt@diamondarmlab.com.

5. Subscriptions and Billing

• Free Trial: New accounts receive a 7-day free trial. A valid payment method is required to start the trial.

• Billing: After the trial, your payment method will be charged the applicable subscription fee on a recurring basis.

• Cancellation: You may cancel at any time. Access continues through the end of the current billing period. No refunds for partial periods.

• Failed Payments: If a payment fails, access to premium features may be suspended until payment is resolved.

• Price Changes: We will notify you at least 30 days in advance of any price changes.

All payments are processed securely through Stripe. We do not store your payment card information.

6. SMS Messaging

By providing your phone number and enabling SMS reminders, you consent to receive automated text messages from Diamond Arm Lab at the number provided.

• Message types: Scheduled throw day reminders and app notifications

• Frequency: Based on your configured throw schedule (up to once per day)

• Opt-out: Reply STOP at any time to unsubscribe

• Help: Reply HELP for support information

• Carriers: Message and data rates may apply

• Under-13 players: SMS reminders route to the parent or guardian's phone, not the player's

Consent to SMS is not a condition of purchase. You may use the Service without enabling SMS reminders.

7. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations

• Submit false or misleading information

• Attempt to gain unauthorized access to any part of the Service

• Interfere with or disrupt the Service or its servers

• Scrape or extract data from the Service without authorization

• Impersonate any person or entity

8. Health and Medical Disclaimer

Important: Diamond Arm Lab does not provide medical advice. All content is for informational and educational purposes only.

ACWR tracking, exercise recommendations, and arm care content are based on general sports science principles and are not a substitute for professional medical advice, diagnosis, or treatment.

Always consult a qualified healthcare provider before starting any exercise program or if you have concerns about pain or injury. Use of this Service does not create a patient-provider or athletic trainer relationship.

9. Intellectual Property

All content, features, and functionality of the Service are owned by Major League Activation LLC and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes. Data you enter remains yours. You grant us a limited license to use that data to operate and improve the Service.

10. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY WASHINGTON STATE LAW, MAJOR LEAGUE ACTIVATION LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Termination

We may suspend or terminate your access at any time for violation of these Terms. You may close your account at any time by contacting matt@diamondarmlab.com.

12. Governing Law

These Terms are governed by the laws of the State of Washington. Any disputes shall be resolved in state or federal courts located in Washington State.
