Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Diamond Arm Lab (the “Service”), operated by Major League Activation LLC, a Washington State limited liability company located at 1402 Lake Tapps Pkwy SE, Ste. F104-334, Auburn, WA 98092. By creating an account or using the Service, you agree to these Terms.

Acceptance of Terms

By accessing or using the Service, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, do not use the Service.

Description of Service

Diamond Arm Lab enables tracking of throwing workloads and arm care for youth baseball players. Features include acute-to-chronic workload ratio (ACWR) monitoring, session logging, curated throwing programs, strength and recovery logging, an exercise library, a coach portal, opt-in SMS reminders, and AI-assisted video analysis of throwing mechanics.

Accounts and Eligibility

• The Service is available to users aged 18 and older who can enter into a binding contract.
• Users aged 13 to 17 may use the Service only with verifiable parental or guardian consent.
• Accounts tracking children under 13 must be created and managed by the child's parent or legal guardian.
• You are responsible for keeping your credentials secure and for all activity that occurs under your account.

Children's Privacy (COPPA)

For users under 13, we collect personal information only with verifiable parental consent and handle that information in accordance with the Children's Online Privacy Protection Act (COPPA). Video uploads involving minors require a parent-verified consent code before any analysis occurs. See our Privacy Policy for details.

Subscriptions and Billing

• Diamond Arm Lab offers a seven-day free trial that requires a valid payment method at signup.
• Paid subscriptions renew automatically at the end of each billing period unless cancelled before the next charge.
• You may cancel at any time. Access continues through the end of the current billing period. No refunds for partial periods.
• All payments are processed by Stripe. We never see or store your full card number.

SMS Messaging

SMS reminders are opt-in and based on your configured throw schedule, up to once per day. Messages for recipients under 13 are sent to the parent or guardian's phone number. Standard message and data rates may apply. Reply STOP to unsubscribe at any time.

Acceptable Use

You agree not to misuse the Service, including attempting to access it by automated means, reselling access, submitting false data, or uploading content that infringes the rights of others.

Health and Medical Disclaimer

The Service provides informational and educational content only. It does not create a patient-provider or athletic-trainer relationship, and it is not a substitute for medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider for questions about a medical condition. If you suspect an injury, stop using the athlete and seek in-person care.

Intellectual Property

The Service, including its software, content, curated throwing programs, exercise library, and branding, is owned by Major League Activation LLC and protected by intellectual property law. You may not copy, modify, distribute, or create derivative works without written permission.

Disclaimers and Limitation of Liability

The Service is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind. To the maximum extent permitted by law, Major League Activation LLC and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service.

Termination

We may suspend or terminate your access to the Service at any time for violations of these Terms. You may cancel your account at any time by emailing support@diamondarmlab.com or from the Billing page inside the Service.

Governing Law

These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-laws principles. Any dispute will be resolved in the courts of King County, Washington.
